This is a great read for employers and HR professionals who manage employee contracts and agreements. Two court cases were presented, both of which resulted in the judge ruling that there was an imbalance of power between the employer and the employee. What does this mean for employers? Just because you put a clause in an agreement or contract to financially protect your company, it does not mean that it will hold up especially if there is a severe imbalance of power between the employer and the employee.
